Introduction 

In this report, we will discuss the professional ethics of an organization. In the case study, the KSoft organization want to expand their organization in a different region. To obtain that goal of organization, they hired a particular associate to do this job named Shawn. The organization wants him to take permission regarding the office setup to be established in a foreign location. In the whole procedure the main problem comes up in professional ethics, these ethics are those ethics that guide the nature of the group or a person in a corporate environment like professional ethics and values should be maintained concerning the organization. In this case, the manager breaks some laws by giving bribes to accelerate the approval procedure. In this below report some points related to ethical laws are discussed, some views have been provided.

Internal and External Stakeholders 

In the case there are some internal and external stakeholders are involved, the internal stakeholders are the employees and management team of the organization (Shawn, management team, and Lan). The external stakeholder is Peter (officer in permit providing department) who is supposed to approve the documentation of the new office. By breaching the law and professional ethics both the stakeholders were affected because as they are giving bribes to Peter and there is an investigation has initiated against Peter from the government side which also hampers the career of Shawn and the brand reputation of KSoft organization.

Moral Standard of an Individual

According to my, everyone has breached the moral standard at some point. The initiation of this practice starts with Peter he asked for extra fee from Shawn, then Shawn gets approval to pay an extra fee so ultimately KSoft’s management has become the culprit for the activity performed to accelerate the procedure. They should have avoided it because this price breached the moral standards and might affect the company’s long-term goal as the company is performing impressively in their sector.

Pressure behind the Ethical Issue

The pressure is created by the management team on the manager of Shawn named Lan. The ultimate pressure was created by the manager of Lan because they want to expand the business as soon as possible and due to some unpredicted problems, Shawn was unable to take the permit on the committed deadline and Lan was not at all happy after listening to this and created pressure on Shawn and say do whatever it takes to do to take permit for expansion as soon as possible and here some mistakes were made in pressure.

Insight of Organizational Culture

Ethical culture can be explained as a set of assumptions, expectation, and assumptions of employees and managers of the particular company prevent them from taking any unethical actions and encourage them to act ethically in every situation. In the scenario of KSoft, we found out that the managers are not following the ethical culture and breached the policy by giving bribes to fasten the process of permit and taking unethical steps which might harm the image of the company and resulting in degrading the values of the organization.

Required Code of Ethic 

In every organization, there are a certain set of rules and policies which an organization must follow to maintain the integrity and a sustainable environment at the workplace. To guide this situation where they have breached the law to get the permit as soon as possible. According to a code of ethics they must have wait as per the norms instead of paying bribes to the officers, by performing this action they will be marked for breaching the norms and they are treated as per the policy guidelines. This is a very big issue and legal issues which might affect the company’s goodwill and might affect the operational activities in other countries can also lead to shut down the offices and they had to do all the procedure again and that would take more time.

Legal Ramification 

For this kind of practice, there are several laws have been created by the constitution of the nation. Giving bribes to any office is a criminal offense and there is a penalty for this crime. In Australia under the criminal code act 2002, Section 70.2 is a criminal code, according to the this if a person is providing any kind of offering to any official or helping with any other way for their purposes this will be considered as crime. There are several consequences of this section, if a person is convicted under thes section then he/she can be imprisonment for 10 year, a fine of AU$2.22 million or both can be applied.

Affects for KSoft 

Business can be affected in many ways and ultimately business is going to suffer. First of all, that will hamper the business in the financial term because they are paying extra money for the work to be done so the business suffers financially. Second thing if these things come up in the market then the reputation of KSoft will be damaged which the company has built in past years. If they use unethical means to accomplish their goal then it will also hamper KSoft’s code of conduct and their ethical values.

Expected Steps from a Leader

In this particular scenario, the company’s leader should take care of all the actions which are taken against to complete the operational tasks. The leader should have asked to wait until they get permission from the government or should prepare them until they get the permit to set up. In another situation, a team leader will see all the possible outcomes of a situation or action because they have to take care of all the parameters especially when the business is trying to expand, this team leader should guide them and warm them to not to perform any such action in future.

Personal Opinion 

If I consider myself in that situation, in the first instance I would have ignored the offer straightforwardly and informed my higher authorities. If they ask me to continue dealing with that person, I would have taken any legal action against this practice and inform the police about the situation. As this is a legal offense, if anyone is involved in these practices, they will let down their values and morals which will ultimately affect their personality.

Conclusion 

In the above case study, the whole scenario is deepened upon the expansion of KSoft organization and what measure they have taken to expand their business in other countries. In this case, there are many entities are involved and many employees were working on the expansion project. The majority of the things were taken care of by Shawn, Shawn was specially hired for the expansion, and he takes care of all legal procedures and his main task is to take approves and permit to set up KSoft’s setup in that region. According to the organization, this must be done as soon as possible but due to some complications this procedure was stuck for a while and in the meantime, Shawn’s manager put pressure on him. To attain his goal Shawn directly contacted the office to accelerate the procedure but here another officer Peter asked for a bribe and that time he refuses the offer but after discussing with a manager he accepts his offer and this how the KSoft organization fall into this unethical activity and established other offices in other regions. The above report consists of all the parameters and consequences they might face due to this unethical activity.
